Welcome to Menumortu’s Website and virtual shop. These Terms and Conditions ("Terms") govern your use of the Website, including the purchase of artwork or products from the Website. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website. The Website is identified by the domain name “menumortu.com” and the Artist is identified by the artist name Menumortu.

1.     Product Descriptions: All artwork and products available on the Website are described as accurately as possible, including specifications, prices, and variations. However, please note that colors, sizes, and other details may vary slightly due to the nature of artistic works. Please note that some images accompanying the artworks in the shop may be derived from free stock photos, edited with the purpose of showcasing examples of placement.

2.     Order Process: To place an order, you need to provide certain information, such as your name, shipping address, and payment details. By placing an order, you represent that the information you provide is accurate and complete. Once your order is submitted, it constitutes an offer to purchase, which is subject to acceptance by the Artist. The Artist reserves the right to accept or reject any order in its sole discretion.

3.     Payment: Prices on the Website are displayed in Swiss Francs (CHF) and include applicable taxes, shipping and handling fees. Payment can be made using the available payment methods on the Website. All payments are processed securely, and your payment information will not be stored by the Website.

4.     Shipping and Delivery: The Artist will endeavour to ship the artwork or products to the address provided during the order process within the stated timeframe. However, please note that shipping times may vary depending on the shipping destination and other factors beyond the Website's control. Any shipping delays or issues will be communicated to you as soon as possible. The shipment will be done as safely as possible on behalf of the artist, in accordance with the default shipment method, or the shipment option you selected. The artist is not liable for any structural damage to the artwork originating in the shipment process (after the artist entrusts the artwork to the post office), unpacking or framing the artwork.

5.     Returns and Refunds: If you are not satisfied with your purchase, please contact the Website within 3 days of receiving your order to request a return or refund. Returns or refunds will be considered on a case-by-case basis, and the Website may require proof of purchase and/or return of the artwork or product in its original condition. Please note that personalized or custom-made items may not be eligible for returns or refunds. Damage to the product that are outside the Artist’s control (see above) are not subject to refunds.

6.     Intellectual Property: All content on the Website, including artwork, images, and text, are protected by intellectual property laws, including copyrights and trademarks. You may not use, reproduce, or distribute any content from the Website without prior written permission from the Artist. In the case of purchase of an art print or original artwork, you may only use them for private display (i.e. home, office, private social media account posts that mention the Artist). It is not permitted to use the artwork otherwise (e.g. a poster, re-printing, resale or creation of Non-fungible Tokens)  without written permission from the artist (official contract or agreement) or without buying the reproduction & distribution rights.

7.     Privacy Policy: The Website collects and uses personal data in accordance with its Privacy Policy, which can be found on the Website. By using the Website, you consent to the collection, use, and protection of your personal data as outlined in the Privacy Policy.

8.     Disclaimer: The Artist strives to provide accurate and reliable information on the Website, but makes no warranties or representations regarding the accuracy, completeness, or reliability of the content. The Artist is not liable for small errors, omissions, or inaccuracies on the Website, or for any damages or losses arising from the use or purchase of the artwork or products.

9.     Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflicts of law principles. Any disputes arising out of or in connection with these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the courts in Zurich, Switzerland.

10.  Modifications and Termination: The Website reserves the right to modify, suspend, or terminate the Website, or these Terms, in whole or in part, at any time without prior notice. Any modifications to these Terms will be effective upon posting on the Website. Your continued use of the Website after any modifications constitutes your acceptance of the modified Terms.
